Kurt Iswarienko is suing Shannen Doherty‘s ex-managers after the company failed to pay the actress’ 2014 premium for her medical insurance which caused her to lose coverage for an entire year and not get the proper medical treatment for her breast cancer.
According to the documents obtained by PEOPLE, Iswarienko filed papers against the firm Tanner Mainstain Glynn & Johnson on Friday, claiming that Doherty’s breast cancer has damaged their love life.
Iswarienko’s lawsuit states that his wife received a late breast cancer diagnosis due to the company’s failure to pay Doherty’s 2014 premium for her medical insurance, resulting in a policy lapse for an entire year. Once the former 90210 star regained insurance the following year, she endured “invasive treatment, including mastectomy, chemotherapy and radiation.”
The lawsuit alleges that due to his wife’s illness, Iswarienko, who married Doherty in 2011, suffered loss of “love, companionship, comfort, affection, solace, society, moral support, sexual relations and all other elements of consortium,” that resulted in “pain, suffering, mental and emotional distress and worry.”
Tanner Mainstain Glynn & Johnson didn’t immediately respond to PEOPLE’s request for comment.
The photographer’s new lawsuit comes on the heels of his wife’s settlement against the managers in August. Her lawsuit at the time claimed that she “discovered that she had invasive breast cancer metastatic to at least one lymph node,” and “was informed that her cancer had spread during 2014 (when she was uninsured).” The amount that the 45-year-old and the defendant settled for was not disclosed.
The actress, who is currently undergoing treatment, has been very open about her cancer battle and frequently shares uplifting thoughts and pictures on her social media. She has also credited her “strong husband” for sticking by her side throughout the grueling process.
“My marriage was always strong, but it’s made my marriage a thousand times stronger,” Doherty previously said in an episode of Entertainment Tonight. “I could not have gotten through this without my husband.”
